These Terms of Service ("Terms") govern your access to and use of the Betterself mobile application and related services (collectively, the "App") operated by Betterself Inc. ("Betterself," "we," "our," or "us").
01Eligibility
You must be at least 13 years old to use the App. By using Betterself, you represent that you meet this requirement and have the legal capacity to enter into these Terms. If you are between 13 and the age of majority in your jurisdiction, you represent that you have your parent or legal guardian's permission.
02Nature of the service
Betterself provides AI-powered fitness, nutrition, and wellness content intended to help users plan workouts, meals, and healthy habits, including a personalized AI coach ("Your Betterself").
Betterself does not provide medical advice. All content is provided for educational and informational purposes only.
03Health disclaimer
You acknowledge and agree that:
- Betterself does not provide medical, nutritional, psychological, or health advice
- Betterself is not a healthcare provider
- The AI coach is an automated system, not a licensed professional
- Any actions you take based on information from the App are taken at your own risk
You should consult a qualified healthcare professional before beginning any fitness, nutrition, or health program.
04User accounts
To access the App, you must create an account.
You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Be responsible for all activity that occurs under your account
- Notify us immediately of any unauthorized use
Betterself is not responsible for unauthorized access caused by your failure to secure your account.
05Acceptable use
You agree not to:
- Use the App for unlawful purposes
- Interfere with or disrupt the App or its systems
- Attempt to access data not intended for you
- Reverse engineer, copy, decompile, or exploit the App, its source code, or its AI systems
- Use the App to harass, harm, or deceive others
- Use automated means (bots, scrapers) to access the App
- Submit content that is illegal, harmful, or infringes anyone's rights
We reserve the right to suspend or terminate accounts that violate these Terms.
06Subscriptions, billing, and cancellation
a. Subscription plans
Betterself offers subscription plans, including:
- Monthly — $9.99 per month
- Annual — $59.99 per year
All subscriptions include a 7-day free trial for new users. Prices are shown in your local currency at checkout and may vary by region.
b. Auto-renewal
Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the then-current subscription plan.
c. Managing and canceling your subscription
You can manage or cancel your subscription at any time through your Apple ID account settings:
Settings › [your name] › Subscriptions
Canceling stops future renewals but does not refund the current billing period unless required by law.
d. Free trial
The free trial automatically converts to a paid subscription at the end of the trial period unless canceled at least 24 hours before the trial ends. You may only be eligible for one free trial per Apple ID.
e. Refunds
All purchases are processed through the Apple App Store and are subject to Apple's refund policies. To request a refund, visit: reportaproblem.apple.com
f. Price changes
We may change subscription prices from time to time. Any price changes will be communicated to you in advance, and you will have the opportunity to cancel before they take effect.
07Intellectual property
All content, software, trademarks, logos, designs, and materials within the App — including the "Betterself" name, the "Your Betterself" AI coach, and all associated branding — are owned by or licensed to Betterself Inc. and are protected by intellectual property laws.
You may not copy, modify, distribute, sell, or create derivative works from any part of the App without our prior written consent.
08Your content and license to us
When you submit content to the App (including meal entries, workout logs, habit entries, messages to the AI coach, or any other input), you retain ownership of that content.
You grant Betterself a limited, non-exclusive, worldwide, royalty-free license to use, store, process, and display your content solely to:
- Operate and provide the App to you
- Personalize your experience
- Improve our AI coach and services (in aggregated, anonymized form)
This license ends when you delete your content or close your account, except as required for legal compliance or legitimate business purposes described in our Privacy Policy.
09AI-generated content
The App uses artificial intelligence to generate responses, recommendations, and personalized content. You acknowledge that:
- AI-generated content may be inaccurate, incomplete, or out of date
- AI responses are not a substitute for professional advice
- We are not liable for any decisions you make based on AI-generated content
- The AI does not retain memory of your conversations beyond the retention period described in our Privacy Policy
10Third-party services
The App may integrate with third-party services (such as Apple Health, Sign in with Apple, and Apple's App Store). Betterself is not responsible for the content, policies, or practices of third-party services.
Your use of third-party services is governed by their respective terms.
11Termination
You may stop using the App at any time by canceling your subscription and deleting your account through the App settings.
We reserve the right to suspend or terminate your access to the App if you:
- Violate these Terms
- Misuse the service
- Fail to pay applicable subscription fees
Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
12Limitation of liability
To the fullest extent permitted by law, Betterself and its officers, directors, employees, and partners shall not be liable for:
- Any indirect, incidental, consequential, special, or punitive damages
- Any loss of profits, revenue, data, or goodwill
- Any injury, loss, or harm resulting from your use of the App
- Any reliance on information provided by the App or the AI coach
Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.
13Disclaimer of warranties
The App is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy.
We do not guarantee:
- That the App will be uninterrupted or error-free
- That defects will be corrected
- That the App will meet your specific requirements
- Any particular results from using the App
14Indemnification
You agree to indemnify, defend, and hold harmless Betterself and its officers, directors, employees, and partners from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another person or entity
- Your content submitted to the App
15Dispute resolution, arbitration, and class action waiver
a. Informal resolution
Before filing a formal claim, you agree to contact us at legal@betterselfreal.com and attempt to resolve the dispute informally for at least 60 days.
b. Binding arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the App that cannot be resolved informally shall be resolved through binding arbitration administered by JAMS in Miami-Dade County, Florida, in accordance with the JAMS Streamlined Arbitration Rules. The arbitrator's decision will be final and binding.
c. Class action waiver
You and Betterself agree that any dispute will be brought in an individual capacity only, and not as a plaintiff or class member in any class, collective, or representative action. The arbitrator may not consolidate more than one person's claims.
d. Exceptions
Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court for intellectual property or confidentiality violations.
e. Opt-out
You may opt out of the arbitration agreement within 30 days of first accepting these Terms by sending written notice to legal@betterselfreal.com. Your notice must include your name, account email, and a clear statement that you opt out of arbitration.
16Governing law and venue
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Subject to the arbitration provisions in Section 15, any action not subject to arbitration shall be brought in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of those courts.
17Copyright complaints (DMCA)
If you believe content on the App infringes your copyright, please send a notice to copyright@betterselfreal.com that includes:
- Identification of the copyrighted work claimed to be infringed
- Identification of the material that is allegedly infringing
- Your contact information
- A statement that you have a good-faith belief the use is not authorized
- A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner
- Your physical or electronic signature
18Changes to these terms
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by email. Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.
19Miscellaneous
- Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Betterself regarding the App.
- Severability. If any provision is found unenforceable, the remaining provisions will remain in full effect.
- No waiver. Our failure to enforce any provision does not waive our right to enforce it later.
- Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets.
- Apple. Apple is not a party to these Terms. Apple is not responsible for the App or its content.
